Step 1
Credit Report: Branch Managers are required to authorize a credit report through NMLS. The Branch Manager will be required to complete an Identity Verification Process (IDV) along with an individual attestation before a license request can be filed through NMLS. Branch Manager must also meet and submit the requirements, as applicable, of Idaho’s Financial Responsibility Policy Statement 2017-01 which may be obtained at http://finance.idaho.gov. MU2/CONTROL PERSON (Branch Manager-if not an Idaho-licensed MLO) Credit Report Explanation: Submit a line by line, detailed letter of explanation of all derogatory credit accounts along with proof of payoffs/settlements, payment arrangements and evidence of payments made, or evidence of any formal dispute filed (documents must be dated). Accounts to address include, but are not limited to: collections items, charge offs (including those reflecting a zero balance but indicate transferred to another lender), accounts currently past due, accounts with serious delinquencies in the last 3 years, repossessions, loan modifications, etc. Note: Items regarding bankruptcy, foreclosure actions, outstanding judgments or liens, or delinquent child support payments should be addressed in the Disclosure Explanations section of your Individual Form (MU2) and/or (MU4). These items will not be reflected on a credit report. MU2 Individual FBI Criminal Background Check Requirements: When added to the Branch Form (MU3), the following Individuals, as specified below, are required to authorize a FBI criminal background check (CBC) through NMLS. $36.25 FBI Criminal Background Check fee will be charged per FBI CBC authorization. ●Branch Manager(s) After the authorization of the FBI criminal background check through the submission of the Company Form (MU1) and Individual Form (MU2), you must schedule an appointment to be fingerprinted. See the Criminal Background Check section of the NMLS Resource Center for more information. Note: If you are able to ‘Use Existing Prints’ to process the FBI criminal background check, you DO NOT have to schedule an appointment. NMLS will automatically submit the fingerprints on file. If the Branch Manager is an Idaho-licensed MLO the CBC requirement will be completed through that license process. See the License Requirements and Fees Chart on the NMLS Resource Center for details related to this requirement. Foreign Background Check: For each control person who does not or has not resided in the United States for at least 5 years prior to the entity’s application for licensure, an investigative background report must be prepared by an independent search firm and submitted directly to the Idaho Department of Finance. At a minimum, the report must contain the following: (1) A comprehensive credit report/history; (2) Civil court and bankruptcy court records for the past 5 years, including a search of the court data in the country(ies), states, towns, where the individual resided and worked and in contiguous areas; and (3) Criminal records for the past 7 years, for any felonies, misdemeanors and violations including a search of court data in the country(ies) states, towns, where the individual resided and worked and in contiguous areas. The report(s) must be dated within 30 days of the application submission date. If the report(s) are prepared in any language other than English, a translation into English must be attached. Other Trade Names: If applicant will be operating under a name other than its legal name, such as a “dba” or “trade” name, it must be included on the Company Form MU1. Upload a file-stamped copy of the Certificate of Filing ABN from the Idaho Secretary of State to the Trade Name/Assumed Name Registration Certificates document upload category. Disclosure Questions: Provide an explanation for any “Yes” response. Upload a copy of any applicable orders or supporting documents in NMLS. A separate entry is required for each event and each “yes” response. Branch Manager: A branch manager must be designated for each licensed location. Branch manager is defined as an individual whose principal office is physically located in, who oversees, and/or who is responsible for the business operations of a branch office. Who is required to have this license?
Any additional physical location of the entity, other than the “Home/Main” location licensed under the Form MU1, regardless whether inside or outside of Idaho, unless exempt, that makes residential mortgage loans to borrowers, for compensation or gain, or in the expectation of compensation or gain, either directly or indirectly, accepts or offers to accept applications for residential mortgage loans, assists or offers to assist in the preparation of an application for a residential mortgage loan on dwellings as defined in section 103(v) of the truth in lending act located in Idaho and regardless of occupancy level.
Any additional physical location of the entity, other than the “Home/Main” location licensed under the Form MU1, regardless whether inside or outside of Idaho, unless exempt, who for compensation or gain, or the expectation of compensation or gain, either directly or indirectly, accepts or offers to accept an application for a residential mortgage loan, assists or offers to assist in the preparation of an application for a residential mortgage loan on behalf of a borrower, negotiates or offers to negotiate the terms or conditions of a residential mortgage loan with any person making residential mortgage loans or engaging in loan modification activities on behalf of a borrower on dwellings as defined in section 103(v) of the truth in lending act located in Idaho and regardless of occupancy level.
Who does not need this license?
Any additional physical locations of the entity not engaged in mortgage origination activities in Idaho.
Any additional physical location of the entity that is properly licensed at a specific physical address that expands to occupy additional suite(s)/space with a separate suite/space identifier at the same physical address. Notification to the Department of the expanded location(s) must be provided outside NMLS.
