Kansas Mortgage Loan Originator License

Pursuant to K.S.A. 9-2201 et seq. and amendments thereto, the Kansas Mortgage Business Act (KMBA), a Mortgage Loan Originator (MLO) License is required for any individual conducting mortgage business involving loan origination on behalf of a single mortgage company licensed to conduct mortgage activity in Kansas. Requirements (5)

  1. Step 1

    A sponsorship request must be submitted by your employer before your application request will be approved. If the applicant is not currently employed by a licensed mortgage company, the license request will remain in pending status until sponsorship by a licensed mortgage company is acquired. You are not authorized to conduct business in a pending status.
  2. Step 2

    Investigative Background Report: If the individual has resided outside of the United States at any time during the 10-year period immediately preceding the individual's application, the individual shall also provide an investigative background report prepared by an independent search firm. Investigative reports can be uploaded to NMLS or sent directly to the Kansas OSBC. Note: The Investigative Background Report is required in addition to completing a Criminal Background Check (CBC) through the NMLS and any other background information required in the application.   3. Step 3

    Credit Report Explanations: Items regarding bankruptcy, foreclosure actions, outstanding judgments or liens, or delinquent child support payments should be addressed in the Disclosure Explanations section of your Individual Form (MU4). Include proof of payoffs, payment arrangements and evidence of payments made, or evidence of any formal dispute filed. This document should be named Credit Report Explanations – Sub Name – Document Creation Date.

  4. Step 4

General information

Who does not need this license? • Any individual engaged solely as a loan processor or underwriter who performs clerical or support duties as an employee at the direction and subject to the supervision and instruction of a person licensed or exempt from licensure. Clerical or support duties may include, subsequent to the receipt of an application, the receipt, collection, distribution and analysis of information common for the processing or underwriting of a residential mortgage loan; and communicating with a consumer to obtain the information necessary for the processing or underwriting of a loan, to the extent that such communication does not include offering or negotiating loan rates or terms or counseling consumers about residential mortgage loan rates or terms. • An individual engaging solely in loan processor or underwriter activities shall not represent to the public, through advertising or other means of communicating or providing information including the use of business cards, stationery, brochures, signs, rate lists or other promotional items, that such individual can or will perform any of the activities of a loan originator. Pre-requisites for license applications? • Pre-Licensure Education Requirement – mortgage loan originators must complete 20 hours of pre-licensure education. • Criminal background check • Investigative Background report required for any individual that has resided outside of the United States at any time during the 10-year period immediately preceding the individual's application. • Credit check – The OSBC will review the credit report provided as part of its determination of financial responsibility for each mortgage loan originator. • Testing – All mortgage loan originators must pass the National Test Component with Uniform State Content. MLOs must pass with a score of 75% or higher. • Sponsorship – The pending license status of all mortgage loan originators will be considered “inactive” until the licensed MLO is sponsored by a licensed company. Sponsorship requests are submitted by the company through NMLS. Mortgage loan originators may not be sponsored by or perform mortgage origination activities for more than one Kansas licensed company simultaneously and the conduct of mortgage business by the MLO is the responsibility of the Kansas licensed company.
