Step 1

ORGANIZATIONAL CHART. Provide a detailed organizational chart showing the management structure of the company. The chart should include names, titles and job descriptions of each position. If applicant is owned by another entity, provide a chart showing the ownership structure. This must be uploaded to NMLS. Upload this document in NMLS under the Document Type “Organizational Chart/Description” in the Document Uploads section of the Company (MU1) Form. Step 4
ZONING. Provide proof of commercial zoning of company’s location only if the main office and/or a branch of the company are located inside the state of Mississippi. This must be uploaded to NMLS under bond information. The document must appear on official letterhead in letter form, from the zoning authority of the listed location.Submitted via: NMLS
Step 5
BUSINESS PLAN. Provide a detailed business plan for the company’s operations that addresses: the types of loans the applicant will originate and/or fund; if the applicant will participate in the mortgage secondary market as either a seller or purchaser of loans; types and volume of advertising; how residential mortgage lending and/or brokering relates to other activities of the applicant; and the geographic area in which the applicant will operate. This must be uploaded to NMLS. Upload this document in NMLS under the Document Type “Business Plan” in the Document Uploads section of the Company (MU1) Form. COMPANY POLICIES AND PROCEDURES. Provide a copy of the applicant’s company policies and procedures including specifically Regulatory Compliance Policies, Personnel Policies, Operations Policies, Third Party Risk Policies, Underwriting Policies and Training Program Policies. General information
Who is required to have this license?
Any person (individual, sole proprietorship, corporation, limited liability company, partnership, trust or any other group of individuals, however organized) who directly or indirectly or by electronic activity solicits, places or negotiates mortgage loans for others, or offers to solicit, place or negotiate mortgage loans for others that does not close mortgage loans in the company name, does not use its own funds, or who closes mortgage loans in the name of the company, and sells, assigns or transfers the loan to others within forty-eight hours of the closing.
Who does not need this license?
• A depository institution, or an institution regulated by the Farm Credit Administration.
Pre-requisites for license applications?
• Bond amount: An Electronic Surety Bond, made payable to the state of Mississippi in the amount of $50,000.
• Criminal background check: A Criminal Background Check is performed on all natural persons owning 10% or more of the organization, the named Qualifying Individual and all control persons / executive officers listed in NMLS.
• A credit report will be obtained through the NMLS system for all natural persons owning 10% or more of the organization, the named Qualifying Individual and all control persons / executive officers listed in NMLS.
• Experience: Documentation of a minimum of two (2) years’ experience directly in mortgage activities by a natural person named as the Qualifying Individual of the company (only one person shall be named as the Qualifying Individual for MS).
• Zoning: If the location of the company’s main office is inside the state of Mississippi, then proof of zoning from the city / county must be submitted to the Department showing that a commercial business may be located at this site.
• At least one employee of the lender shall be licensed as a loan originator at a licensed location.
