Oregon Mortgage Lending Branch License

Each fixed physical location from which a licensed Mortgage Lending company, or its representatives, offers the services of mortgage brokering, lending or loan origination in connection with an Oregon residential mortgage transaction. A transaction is an Oregon residential mortgage transaction if the loan is to be secured by 1-4 family residential property and is a loan: 1) for a consumer located in Oregon, 2) on property located in Oregon or 3) made from a fixed physical location in Oregon. Like the main office on the MU1, the branch office address on the MU3 is not required to be inside Oregon State.

  1. Step 1

    Registration of Name (only for addition of trade name for a branch): You must register any dba with the Oregon Secretary of State Corporation Division prior to being issued a license to conduct Oregon residential mortgage lending activity under that name.   2. Step 2

    Addition of Branch Other Trade Name (OTN): If adding a new other trade name for the branch location during the application process, complete the following steps. • Add the OTN to the Other Trade Name section of the Branch Form (MU3). • Submit an amendment for the addition of the OTN through the Company Form (MU1) in NMLS.

  3. Step 3

    Trust Accounting (only for addition of trade name for a branch): If you NEVER (not even reimbursement at closing) intend to accept monies from borrowers or on behalf of borrowers for the payment of third party service providers, do not submit anything additional. If you do intend to accept client funds, upload to NMLS the completed Notice of Clients' trust account to report each trust account you’ll use with Oregon State Loans. The form must include the full legal name of the applicant as well as all trade names used in Oregon. The trust account must be located at a federally insured depository institution that has a physical location in Oregon State.

  4. Step 4

    Branch Manager: A branch manager must be designated for each licensed location. Branch manager is defined as an individual whose principal office is physically located in, who is in charge of, and who is responsible for the business operations of a branch office.

Who is required to have this license? Each fixed physical location from which a licensed Mortgage Lending company, or its representatives, offers the services of mortgage brokering, lending or loan origination in connection with an Oregon residential mortgage transaction. A transaction is an Oregon residential mortgage transaction if the loan is to be secured by 1-4 family residential property and is a loan: 1) for a consumer located in Oregon, 2) on property located in Oregon or 3) made from a fixed physical location in Oregon. Like the main office on the MU1, the branch office address on the MU3 is not required to be inside Oregon State. Who does not need this license? • If your company has branches outside Oregon, and those branches will not provide brokering, lending or originations services for loans on Oregon property and serve Oregon residents, those branches do not need to hold an Oregon State branch license. • If your company is exempt from the Mortgage Lending licensing requirements, your branches are also exempt. Oregon Division of Financial Regulation does not issue paper licenses for this license type. The Oregon Licensing Notice may be printed on the Division’s website for posting in the licensed office.
