Maryland Affiliated Insurance Producer-Mortgage Loan Originator License

An Affiliated Insurance Producer is an individual who originates mortgage loans (i.e., takes loan applications and/or offers or negotiates the terms of mortgage loans). An individual is eligible for this license if the individual: 1) originates mortgage loans only on behalf of a financial institution that is described in Md. Code Ann., Fin. Inst. § 11-502(b)(1) that is approved by the Commissioner; 2) is a licensed insurance producer in good standing; and 3) holds an appointment as an insurance producer for an insurer that controls, is controlled by, or is under common control with either the financial institution described above or a mortgage lender licensee that is approved by the Commissioner and only originates loans for the financial institution described in Md. Code Ann., Fin. Inst. § 11-502(b)(1) under an exclusive contract with that financial institution. Refer to Md. Code Ann., Fin. Inst. § 11-601 et seq. (Maryland Mortgage Originator Law) for legal requirements.

  1. Step 1

    Issuance of “Approved-Inactive” License: If you are not currently employed by a mortgage company (as shown on the employment history), the license will be issued as “Approved-Inactive” until sponsorship by a licensed or exempt mortgage lender is provided. A licensee is not authorized to engage in mortgage loan origination activities with an “Approved-Inactive” status. The “Approved-Inactive” status indicates that the licensee meets all licensing requirements of the Maryland Mortgage Originator law except employment, but will be able to originate loans once the sponsorship is submitted and approved through the NMLS. Incomplete Application: If your application package is incomplete (including explanations and/or required documentation submitted in an incorrect format) sixty (60) days after the application filing, the Commissioner may terminate the processing of the application and will deem the incomplete application withdrawn by the applicant.

  3. Step 3

    Volume of Mortgage Business: Provide a sworn statement of the volume of mortgage business (including lending, brokering and servicing) conducted by the applicant in the previous twelve (12) months. If the applicant has not conducted a mortgage lending business at any time during the 36 months preceding the application, please also state in the sworn statement.

  4. Step 4

    Surety Bond: (Please circle the appropriate statement below) The applicant is covered under a blanket surety bond, in the amount of $1,000,000, held by the financial institution or mortgage lender licensee; OR The applicant has attached a surety bond that is based on the aggregate volume of mortgage lending business conducted in the previous twelve (12) months.   5. Step 5

    Certificate of Good Standing: Provide copy of certification from the Maryland Insurance Administration that applicant is an insurance producer in good standing under § 10-103 of the Insurance Article.

  6. Step 6

    Sponsorship Certificate: Provide a sponsorship certificate signed by an authorized officer of the employing entity. Use the sponsorship certificate form found below.   7. Step 7

    Criminal Background Check Clarifications: If any negative criminal history is reported on your Federal criminal history report, the applicant must submit a written explanation and any applicable supporting legal documentation. (This documentation includes, but is not limited to the final dispositions, orders of expungement, and any other court documents. If the documents are unavailable, provide a letter from the court that states that the documents are unavailable.)
  8. Step 8

    Disclosure Questions: Provide an explanation for any “Yes” response. Upload a copy of any applicable orders or supporting documents in NMLS.

PLEASE READ THE ELIGIBILITY REQUIREMENTS BELOW. IF YOU ARE NOT EMPLOYED BY AN INSURER, PLEASE DO NOT APPLY FOR THIS LICENSE! Who is eligible to receive this license? An individual who: • Is a licensed insurance producer in good standing under Md. Code Ann., Ins. Art. § 10-103; and • Holds an appointment as an insurance producer for an insurer that controls, is controlled by, or is under common control with: • a financial institution in Md. Code Ann., Fin. Inst. Art. § 11-502(b)(1) that is approved by the Commissioner; or • a mortgage lender licensee that is approved by the Commissioner and • Only originates loans for a financial institution as described above under an exclusive contract with that financial institution; andOriginates mortgage loans only on behalf of mortgage lender licensee or a financial institution that is described above. Who is not eligible to receive this license? • An individual who is not an insurance producer meeting the requirements described above. Pre-requisites for license applications? • No revocations of a mortgage loan originator license in any jurisdiction. • No convictions of, guilty or nolo contendere pleas to a felony in a domestic, foreign or military court during the 7-year period immediately preceding the date of the application for licensing. • No convictions of, guilty or nolo contendere pleas to a felony involving an act of fraud, dishonesty, breach of trust, or money laundering, in a domestic, foreign or military court at any time preceding the date of the application. • Financial Responsibility. • Pre-licensing education and testing. • Education: Complete 20 hours of NMLS approved pre-licensure education courses, which shall include 3 hours of Maryland mortgage-related law and 2 hours of Maryland finder’s fee law – NMLS must indicate your compliance with this requirement. _______________________________ Testing: Must satisfy one of the following three conditions: 1) Passing score on both the National and Maryland State components of the SAFE Test, or 2) Passing score on both the National and Stand-alone UST components of the SAFE Test, or 3) Passing score on the National Test Component with Uniform State Content NMLS must indicate your compliance with this requirement. • Applicant must demonstrate character and general fitness sufficient to command the confidence of the community and to warrant a determination that the applicant will operate as a mortgage originator in a lawful, honest, fair, and efficient manner. • Criminal background check - State and Federal. • Licensed insurance producer that is in good standing under Md. Code Ann., Inst. § 10-103. • Sponsorship by the applicant’s employer. • Hold an appointment as an insurance producer for an insurer that controls, is controlled by, or is under common control with: • A financial institution as described in Md. Code Ann., Fin. Inst. Art. § 11-502(b)(1) that is approved by the Commissioner; OR • A mortgage lender that is approved by the Commissioner and only originates on behalf of a financial institution described in Md. Code Ann., Fin. Inst. Art. § 11-502(b)(1) (which is approved by the Commissioner) under an exclusive contract with that financial institution.
