Who is required to have this license?
Any business entity, including a sole proprietorship, who for compensation or gain, or in the expectation of compensation or gain, either directly or indirectly takes a residential mortgage loan application, or offers, negotiates, originates, or acquires residential mortgage loans in the primary market. Residential mortgage loans include both first and second mortgage loans on New Jersey property.

Step 1
Submission of Branch Form (MU3): Complete and submit the Branch Form (MU3) in NMLS. This form serves as the application for the license through NMLS.Submitted via: NMLS
Step 2
Other Trade Names: If this branch is operating under a name that is different from the applicant’s legal name, that name (“Trade Name”, “Assumed Name” or “DBA”) must be listed under the Other Trade Names section of both the Branch Form (MU3) and the Company Form (MU1). The New Jersey Department of Banking and Insurance does not allow more than three (3) other trade names. Note: When adding an Other Trade Name to a Branch Form (MU3), it must also be added to the Company Form (MU1).Submitted via: NMLS
Step 3
Branch Manager: A Branch Manager must be designated for each licensed location. A Branch Manager is defined as an individual whose principal office is physically located in, who is in charge of, and who is responsible for the business operations of a branch office. Branch Manager should hold an active NJ MLO license or an active federal MLO registration. If the Branch Manager is not a licensed New Jersey MLO or a federally registered MLO, an affidavit must be submitted affirming that the Branch Manager will not conduct activity that requires a New Jersey MLO license.Submitted via: NMLS
Step 4
Branch Manager (MU2) Attestation: Complete the Individual Form (MU2) in NMLS. This form must be attested to by the applicable branch manager before it is able to be submitted along with the Branch Form (MU3).Submitted via: NMLS

Credit Report: Branch Managers are NOT required to authorize a credit report through NMLS.Step 6
MU2 Individual FBI Criminal Background Check Not Required Through NMLS: Branch Managers are NOT required to authorize a FBI criminal background check (CBC) through NMLS.Step 7
Certification Of Office Suitability: Upload a certification of office suitability. The forms may be found at: Offices Located In New Jersey or Offices Located Outside of New Jersey. This document should be named NJ Certificate of Office Suitability
General information
Who does not need this license?
• Depository institutions
• A licensed attorney who negotiates terms of a residential mortgage loan on behalf of a client as an ancillary matter to the attorney’s representation of a client, unless the attorney is compensated by a residential mortgage lender or residential mortgage broker
• A person licensed as a NJ real estate broker or salesperson and not engaged in the business of a residential mortgage lender or residential mortgage broker
• Any employer, who is not a residential mortgage lender, who provides residential mortgage loans to his employees as a benefit of employment and which are not in excess of the usury rate in New Jersey at the time the loan is made and on which the borrower has not agreed to pay, directly or indirectly, any charge, cost, expense, or any fee whatsoever, other than interest
• Any individual who offers or negotiates terms of a residential mortgage loan: (1) with or behalf of an immediate family member; or (2) secured by a dwelling that served as the individual’s residence
The governing statute is the New Jersey Residential Mortgage Lending Act, N.J.S.A. 17:11C-51 et seq.
