Oklahoma Mortgage Broker License

This license is required of any business entity, who for compensation or gain, or in the expectation of compensation or gain, takes a residential mortgage loan application or offers, negotiates or modifies the terms of an existing residential mortgage loan on Oklahoma residential property for others. 59 O.S. § 2095.2 (13)

  1. Step 1

    Other Trade Name: If operating under a name that is different from the applicant’s legal name, that name (“Trade Name”, “Assumed Name” or “DBA”) must be listed under the Other Trade Names section of the Company Form (MU1). Important – A separate license is no longer required for the use of multiple trade names. Oklahoma allows up to 10 trade names per license. Each additional trade name used by a licensee shall be registered with the Department by completing an MU1 for a Broker Name Registration - Other Trade Name through NMLS and paying the $150.00 registration fee. The licensee should upload a file-stamped copy of the Trade Name/Fictitious Name Certificate from the Oklahoma Secretary of State. Oklahoma SAFE Act - 59 O.S. § 2095.6(K)(11)

  2. Step 2

    Resident/Registered Agent: The Resident/Registered Agent must be listed under the Resident/Registered Agent section of the Company Form (MU1).

    Qualifying Individual: This individual must be listed in the Qualifying Individual section of Company Form (MU1). The Qualifying Individual must be licensed as a mortgage loan originator in the state of Oklahoma.

    MU2 Individual FBI Criminal Background Check Requirements: See the License Requirements and Fees Chart on the NMLS Resource Center for details related to this Requirement. Criminal Disqualification: Please note that criminal offenses may be used as a basis for denial. You may request a determination whether or not your criminal background may disqualify you from obtaining a licensing pursuant to 59 O.S. § 4000.1 (F). To see a list of criminal offenses that may be used as a basis for a denial of licensure, please visit: https://www.ok.gov/okdocc/ After authorizing a FBI criminal background check through the submission of the Company Form (MU1) and Individual Form (MU2), you must schedule an appointment to be fingerprinted if new prints are required.   6. Step 6

    Certificate of Authority/Good Standing Certificate: Upload a State-issued and approved document (typically by the Secretary of State’s office), dated not more than 60 days prior to the filing of the application through NMLS that demonstrates authorization to do business in the State of Oklahoma. This document should be named OK Certificate of Authority OR OK Certificate of Good Standing].

  7. Step 7

    Formation Documents: Determine classification of applicant’s legal status and submit a State certified copy of the requested applicable documentation detailed below. Original formation documents and all subsequent amendments, thereto including a list of any name changes. Sole Proprietor • Trade Name Report issued by the Oklahoma Secretary of State. Unincorporated Association: • By-Laws or constitution (including all amendments). General Partnership: • Partnership Agreement (including all amendments). Limited Liability Partnership: • Certificate of Limited Liability Partnership; and • Partnership Agreement (including all amendments). Limited Partnership: • Certificate of Limited Partnership; and • Partnership Agreement (including all amendments). Limited Liability Limited Partnership: • Certificate of Limited Liability Limited Partnership; and • Partnership Agreement (including all amendments). Limited Liability Company (“LLC”): • Articles of Organization (including all amendments); • Operating Agreement (including all amendments); • IRS Form 2553 or IRS Form 8832 if S-corp treatment elected; and • LLC resolution if authority not in operating agreement. Corporation: • Articles of Incorporation (including all amendments); • By-laws (including all amendments), if applicable; • Shareholder Agreement (including all amendments), if applicable; • IRS Form 2553 if S-corp treatment elected; and • Corporate resolution if authority to complete application not in By-Laws or Shareholder Agreement, as amended, as applicable. Trust (Statutory) • Certificate of Trust; and • Governing instrument (all amendments).

  8. Step 8

    Primary Contact Employees: The following individuals must be entered into the Contact Employees section of the Company Form (MU1). • Primary Company Contact. • Primary Consumer Complaint Contact.

OK DOCC does not issue paper licenses for this license type. Remote work: A licensee may permit its employees or independent contractors to work at remote locations in compliance with the licensee’s written policies and procedures subject to the conditions as outlined: Oklahoma SAFE Act - 59 O.S. § 2095.27
