South Carolina Mortgage Broker Loan Originator License

This license is required for an employee of a mortgage broker, who for compensation or gain, or in the expectation of compensation or gain, directly or indirectly solicits, processes, places, or negotiates a mortgage loan on a South Carolina dwelling for a borrower from a mortgage lender or depository institution, or tablefunds or acts as loan correspondent or brings borrowers and lenders together to obtain a mortgage loan.

  1. Step 1

    Company Sponsorship: A sponsorship request must be submitted by your employer. South Carolina DCA will review and accept or reject the sponsorship request. SC-DCA offers an “Approved-Inactive” license status. If you are not currently employed by a mortgage company (or your employer has not yet requested sponsorship on your behalf) and you have completed all requirements for this license, the license may be issued as “Approved-Inactive” until sponsorship by a mortgage company is acquired. While in an “Approved-Inactive” status, you are NOT authorized to conduct business under the authority of the SC Mortgage Broker Loan Originator license. Multiple sponsorships: South Carolina law does not permit multiple sponsorships. This is not limited to sponsorships with companies licensed in South Carolina. If you have more than one sponsorship, please contact SC-DCA before submitting an application.
  2. Step 2

    If you are registered at a branch office, the branch location must be listed as the employment location. This location must be within seventy-five (75) miles of the applicant’s residence. Remote work is not permitted under South Carolina law. Multiple employments: South Carolina law does not allow employment by more than one mortgage company. This is not limited to employment with companies licensed in South Carolina. If you have more than one employment/sponsorship, please contact SC-DCA before submitting an application.

  3. Step 3

    Criminal Background Information: You may be asked to provide information on misdemeanors in the last ten (10) years and felony convictions beyond ten (10) years.

    Disclosure Questions: Provide an explanation and, if applicable, a supporting document for each “Yes” response. Note: Discharge papers must be uploaded for any bankruptcy proceedings.
  5. Step 5

    Credit Report Explanations: Submit a detailed letter of explanation of all derogatory credit accounts along with proof of payoffs, payment arrangements and evidence of payments made, or evidence of any formal dispute filed (documents must be dated). Accounts to address include, but are not limited to: collections items, charge offs, accounts currently past due, accounts with serious delinquencies in the last 3 years, repossessions, loan modifications, etc. Note: Items regarding bankruptcy, foreclosure actions, outstanding judgments or liens, or delinquent child support payments should be addressed in the Disclosure Explanations section of your Individual Form (MU4). This document should be named Credit Report Explanations – Sub Name – Document Creation Date.

General information

Who is required to have this license? Any natural person who is an employee of a licensed mortgage broker, paid by IRS Form W-2, who for compensation or gain or in the expectation of compensation or gain, whether through contact by telephone, by electronic means, by mail, or in person with prospective borrowers, either: • solicits, negotiates, accepts, or offers to accept applications for mortgage loans, including electronic applications, • or includes direct contact with, or informing mortgage loan applicants of, the rates, terms, disclosures, and other aspects of the mortgage loan. A mortgage loan means any loan made or represented to be made to a natural person or persons primarily for personal, family, or household use that is secured by a mortgage, deed of trust, or other equivalent consensual security interest on a dwelling located within this State or residential real estate upon which is constructed or intended to be constructed a dwelling. Who does not need this license? a) an employee of a licensee whose responsibilities are limited to clerical or support duties for the employer and who does not solicit borrowers, accept applications, or negotiate the terms of loans on behalf of the employer; b) an officer, registered loan originator or employee when acting in the scope of employment of a depository institution or a subsidiary that is wholly owned and controlled by the depository institution and regulated by a federal banking agency or an institution regulated by the Farm Credit Administration c) a person who offers or negotiates terms of a mortgage loan with or on behalf of an immediate family member of the individual; d) an individual who offers or negotiates terms of a mortgage loan secured by a dwelling that served as the person’s residence; e) an employee whose employment as a processor or underwriter is undertaken pursuant to the direction and supervision of a licensee or exempt person except when the processor or underwriter is working as an independent contractor; or f) a manufactured home retailer employee if performing only clerical or support duties in connection with the sale or lease of a manufactured home and the manufactured home retailer and its employees receive no compensation or other gain from a mortgage lender or a mortgage broker for the performance of the clerical or support duties. Clerical or support duties mean administrative functions after the receipt of an application by a licensed mortgage originator or broker, such as gathering information, requesting information, word processing, sending correspondence, or assembling files, and may include: a) The receipt, collection, and distribution common for the processing or underwriting of a residential mortgage loan; or b) Any communication with a borrower to obtain the information necessary for the processing or underwriting of a loan, to the extent that such communication does not include taking a residential mortgage loan application, offering or negotiating loan rates or terms, or counseling consumers about residential mortgage loan rates or terms. Pre-requisites for license applications? • Criminal background check: FBI Criminal Background Check • Credit check • Testing: Must satisfy one of the following three conditions:1) A passing result on both the National and South Carolina State components of the SAFE Test, or 2) Passing results on both the National Stand-alone UST components of the SAFE Test, or 3) Passing results on the National Test Component with Uniform State Content. • Education: at least twenty hours of pre-licensing education and eight hours of continuing education • Prior to submission of the application, complete 20 hours of NMLS-approved pre-licensure education (PE) courses which must include 3 hours of South Carolina content. • Note: South Carolina has two licensing agencies for the mortgage industry. You must select SC-DCA for state-specific credit to be applied to your Mortgage Broker Loan Originator license request. • Maintain a licensed branch location of the mortgage broker licensee if not located at the main branch.
