New Jersey disclosure requirements

When a real estate licensee provides mortgage financing services to a buyer, the licensee must provide written disclosure to the buyer before charging any fees for mortgage financing services. The disclosure must include: all fees the buyer will pay, the amount and source of any compensation to the licensee, and if the licensee places loans with three or fewer lenders or is affiliated with a lender, a statement advising the buyer that they are not obligated to use the licensee's services. Additionally, if the licensee also represents the seller, separate disclosures to the seller and an expanded disclosure to the buyer are required. These requirements are found in N.J. Admin. Code § 11:5-6.7.
