  1. Step 1

    Branch Manager: A Branch Manager must be designated for each licensed location. Branch Manager is defined as an individual whose principal office is physically located in, who is in charge of, and who is responsible for the business operation of the Branch Office.

  2. Step 2

    Credit Report: Individuals in a position of control are required to authorize a credit report through NMLS. Individuals will be required to complete an Identity Verification (IDV) along with an individual attestation before a license request for your company can be filed through NMLS. See the License Requirements and Fees Chart on the NMLS Resource Center for details related to this Requirement.

  3. Step 3

    Disclosure Questions: Provide an explanation for any “Yes” response. Upload a copy of any applicable orders or supporting documents in NMLS.

  4. Step 4

    Branch Written Agreement: Upload a copy of the agreement between the licensee and branch manager, in compliance with applicable state and federal law.

  5. Step 5

    Branch Surety Bond: Submit an Electronic Surety Bond (ESB) Rider to increase the amount of the Mortgage Servicer License Surety Bond by $50,000.00 per Branch License for each licensed branch location and each MLO. Contact your Surety Bond Producer to inform them of the branch application, so the Producer can initiate the Surety Bond Rider process in NMLS.   6. Step 6

    Memorandum of Tax Certification: Provide a completed certified stamped Tax Clearance Form I-9 showing all tax obligations to Guam have been paid. The Form I-9 Tax Clearance can be downloaded via the Government of Guam Forms website at www.govguamdocs.com (under the Department of Revenue and Taxation, under the Insurance, Securities, Banking and Real Estate (ISBRE) Branch. You will need to contact your Guam Registered Agent to Process to complete the Form I-9 in Guam at the Guam Department of Revenue and Taxation. A completed certified stamped Tax Clearance Form I-9 requires all four (4) stamped clearances on the bottom of the form, stamped cleared by the following branches located within the Guam Department of Revenue and Taxation: (1) Business Privilege Tax/Gross Revenue Tax (BPT/GRT) Branch (2) General Licensing/Business License Branch (3) Income Tax Assistance and Processing Branch (ITAPB) (4) Collection Branch Certified stamped Tax Clearance Form I-9 are required for new and renewal of license and are valid for 90 days. Incomplete Form I-9 Tax Clearance will delay the issuance of license.

General information

Who is required to have this license? Any company or Individual that for a fee or compensation provides services from other than a main office located within or off island from Guam which include the receipt of periodic payments from a borrower and making payments of principal and interest, and other payments pursuant to the terms of the loan secured by a residential mortgage. Who does not need this license? • Any person who meets the definition of a mortgage servicer and is an employee of a depository institution or a subsidiary thereof that is regulated by a federal banking agency. Pre-requisites for license applications? • Net worth must be not less than $250,000 tangible assets. • Bond amount must be a minimum amount of $50,000 up to $100,000 for aggregate loans to be collected or serviced over $50,000,000. • Criminal background check – applicant is required to submit and pay all fees required for criminal history background check. • Credit check – applicant shall authorize the NMLS to obtain applicant’s current credit report. • Experience – applicant shall provide personal history and experience and shall include officers, directors, managing members, partners, direct owners and executive officers of the company. • Testing – applicant shall pass a qualified written test developed by NMLS and administered by a test provider approved by NMLS within one year before the date of the filing of the application. • Education – applicant shall complete at least 20 hours of NMLS approved education including 3 hours of instruction on federal law and regulations, 3 hours of ethics including instructions on fraud and consumer protection.
