Step 1
Branch Manager: A Branch Manager must be designated for each licensed location. Branch Manager is defined as an individual whose principal office is physically located in, who is in charge of, and who is responsible for the business operation of the Branch Office.Submitted via: Submit via NMLS.
Step 2
Credit Report: Individuals in a position of control are required to authorize a credit report through NMLS. Individuals will be required to complete an Identity Verification (IDV) along with an individual attestation before a license request for your company can be filed through NMLS. Step 3
Disclosure Questions: Provide an explanation for any “Yes” response. Upload a copy of any applicable orders or supporting documents in NMLS.Submitted via: Submit via NMLS under Qualifying Individual MU2 Associations.
Step 4
Branch Written Agreement: Upload a copy of the agreement between the licensee and branch manager, in compliance with applicable state and federal law.Submitted via: Upload via NMLS under "Document Uploads", under "Branch Written Agreement" subsection.
Step 5
Branch Surety Bond: Submit an Electronic Surety Bond (ESB) Rider to increase the amount of the Mortgage Servicer License Surety Bond by $50,000.00 per Branch License for each licensed branch location and MLO. Contact your Surety Bond Producer to inform them of the branch application, so the Producer can initiate the Surety Bond Rider process in NMLS. Step 6
Memorandum of Tax Certification: Provide a completed certified stamped Tax Clearance Form I-9 showing all tax obligations to Guam have been paid. The Form I-9 Tax Clearance can be downloaded via the Government of Guam Forms website at www.govguamdocs.com (under the Department of Revenue and Taxation, under the Insurance, Securities, Banking and Real Estate (ISBRE) Branch. You will need to contact your Guam Registered Agent to Process to complete the Form I-9 in Guam at the Guam Department of Revenue and Taxation. A completed certified stamped Tax Clearance Form I-9 requires all four (4) stamped clearances on the bottom of the form, stamped cleared by the following branches located within the Guam Department of Revenue and Taxation: (1) Business Privilege Tax/Gross Revenue Tax (BPT/GRT) Branch (2) General Licensing/Business License Branch (3) Income Tax Assistance and Processing Branch (ITAPB) (4) Collection Branch Certified stamped Tax Clearance Form I-9 are required for new and renewal of license and are valid for 90 days. General information
Who is required to have
this license?
Any branch, who for a fee, compensation or gain takes, offers, negotiates,
approves or disapproves the financing of a loan secured by a mortgage with respect
to any dwelling that is located in Guam.
Who does not need this
license?
• A person who meets
the definition of a mortgage loan originator and is an employee of a
depository institution or a subsidiary that is owned and controlled by a
depository institution and regulated by a federal banking agency or Farm
Credit Administration and is registered with and maintains a unique
identifier through the NMLS.
• A licensed
attorney provided the activities are considered by the state’s court to be
a part of the authorized practice of law within Guam and are carried out
within an attorney-client relationship.
• An owner of a real
property who in any twelve (12) consecutive month period makes no more
than five (5) mortgage loans with respect to the real property sold.
Pre-requisites for
license applications?
• Net
worth must be not than $250,000 tangible assets.
• Bond
amount must be a minimum of $50,000 up to $100,000 for aggregate loans over
$50,000,000.
• Criminal
background check – applicant is required to submit and pay all fees required
for criminal history background check.
• Credit
check – applicant shall authorized the NMLS to obtain applicant’s current
credit report.
• Experience
– applicant shall provide personal history and experience and shall include
officers, directors, managing members, partners, direct owners and executive
officers of the company.
• Testing
– applicant shall pass a qualified written test developed by NMLS and
administered by a test provider approved by NMLS within one year before the
date of the filing of the application.
• Education
– applicant shall complete at least 20 hours of NMLS approved education
including 3
hours
of instruction on federal law and regulations, 3 hours of ethics including
instructions on
fraud,
consumer protection fair lending, and 2 hours of training on lending standards
for the
nontraditional mortgage products and Mortgage
