Step 1
Other Trade Name: If operating under a name that is different from the applicant’s legal name, that name (“Trade Name”, “Assumed Name” or “DBA”) must be registered and approved by the Kentucky Secretary of State's office and listed under the Other Trade Names section of the Company Form (MU1). Step 2
Resident/Registered Agent: The Resident/Registered Agent must be listed under the Resident/Registered Agent section of the Company Form (MU1) and must match the information currently on record with Kentucky Secretary of State.Submitted via: NMLS
Step 3
Qualifying Individual: Referred to in KRS 286.8 as the "Managing Principal”. This must be a natural person who meets the requirements of KRS 286.8 and actively participates in and is primarily responsible for the operations of a licensee. The managing principal shall provide sufficient proof of a minimum two years' experience working in the mortgage industry (See Verification of Experience). This individual must be listed in the Qualifying Individual section of Company Form (MU1). The Qualifying Individual must also be a control person named in the Direct Owners/Officers section.Submitted via: NMLS
Step 4
Credit Report: Individuals in a position of control are required to authorize a credit report through NMLS. Individuals will be required to complete an Identity Verification Process (IDV) along with an individual attestation before a license request for your company can be filed through NMLS. Credit Report Explanations: Submit a line by line, detailed letter of explanation of all derogatory credit accounts along with proof of payoffs, payment arrangements and evidence of payments made, or evidence of any formal dispute filed (documents must be dated). Accounts to address include, but are not limited to: collections items, charge offs, accounts currently past due, accounts with serious delinquencies in the last 3 years, repossessions, loan modifications, bankruptcies, foreclosures, outstanding judgments/liens, and delinquent child support payments. This document should be named Credit Report Explanations and uploaded to the Individuals Form MU2.Submitted via: NMLS
Step 5
Financial Statements: Upload a Compiled financial statement prepared by a Certified Public Accountant in accordance with Generally Accepted Accounting Principles dated within 90 days of your fiscal year end. Financial statements should include a Balance Sheet, Income Statement and Statement of Cash Flows and all relevant notes thereto. The balance sheet must reflect positive net worth, but there is no minimum requirement. Note: Financial statements are uploaded separately under the filing tab named Financial Statement. Step 6
Certificate of Authority/Good Standing Certificate: Upload a state-issued document (typically by the state’s Secretary of State office) demonstrating that the Corporation or LLC exists or is authorized to do business in the state. This document should be named [[State prefix] Certificate of Authority OR [State prefix] Certificate of Good Standing].Submitted via: Upload in NMLS under the Document Type Certificate of Authority/Good Standing Certificate in the Document Uploads section of the Company Form (MU1).

Formation Documents: Determine classification of applicant’s legal status and submit a State certified copy of the requested applicable documentation detailed below. Original formation documents and all subsequent amendments, thereto including a list of any name changes. Limited Liability Company (“LLC”): • Articles of Organization (including all amendments); • Operating Agreement (including all amendments) Corporation: • Articles of Incorporation (including all amendments)Submitted via: Upload in NMLS under Formation Document Document Upload section.

Organizational Chart: Submit a chart showing (or a description which includes) the percentage of ownership of: • Direct Owners (total direct ownership percentage must equate to 100%) • Indirect Owners • Subsidiaries and Affiliates of the applicant/licensee This document should be named [Company Legal Name] Organizational Chart – Description. Note: If the existing uploaded Organizational Chart/Description already includes the above information, an additional document does not need to be uploaded.Submitted via: Upload in NMLS under the Document Type Organizational Chart/Description in the Document Uploads section of the Company Form (MU1).
Step 9
Surety Bond: Submit an Electronic Surety Bond via NMLS in the amount of $50,000.00 furnished by a surety company authorized to conduct business in Kentucky. The name of the principal insured on the bond must match exactly the Full Legal Name of applicant. Pre-Licensing Education:Prior to submission of the application, control persons must complete at least 30 hours of NMLS-approved pre-licensure education (PE) and continuing education (CE) courses. Education completed for other states will be accepted. Follow the instructions in the Course Completion Records Quick Guide to confirm that PE has been posted to your record and the PE Total indicates “Compliant.”Submitted via: NMLS
Step 11
Personal Financial Statement: Individuals with 10% or more direct ownership are required to upload a personal financial statement. This document should be named [State Abbreviation] – Personal Financial Statement.Submitted via: Upload in NMLS under the Document Type Personal Financial Statement in the Document Uploads section of the Individual Form (MU2).
Step 12
Prior Activity Attestation: Upload a signed statement indicating if the applicant has ever conducted Kentucky mortgage activity while unlicensed. If transactions have occurred, please provide the total number and dollar amount of transactions for each year. Attestation must be completed by a control person.Submitted via: Upload to NMLS under Additional Requirements Document Upload section.
Step 13
Disclosure Questions: Provide a complete and detailed explanation and document upload for each “Yes” response to Disclosure Questions made by the company or related control persons (MU2). See the Company Disclosure Explanations Quick Guide for instructions.Submitted via: Upload in NMLS in the Disclosure Explanations section of the Company Form (MU1) or Individual Form (MU2).

Contact Employees: Individuals must be identified on the Company Form MU1 in the following areas: • Accounting • Exam Billing • Licensing • Consumer Complaint (Public) • Exam Delivery • Legal • Litigation • Pre-Exam Contact • Primary Company Contact • Primary Consumer Complaint (Regulator)Submitted via: NMLS
Step 15
Verification of Experience: Provide a license specific resume with detailed job descriptions and/or duties performed evidencing experience in the industry the company is applying for a license. Detailed job descriptions and duties with all employers need to be incorporated into a resume to demonstrate experience related to the specific state license being applied for. State specific requirements include: Managing Principal is required to have at least two (2) years of experience working directly in the mortgage industry. Residential Locations: If this business operates from a residential location, the following requirements must be provided: • Approval from Local Planning & Zoning • Disclosure of Residence Form • Copy of Lease/DeedSubmitted via: Upload in NMLS under Additional Requirements Document Upload section.
Step 17
Sponsored Mortgage Loan Originator: Entities with business activities requiring a registered KY Mortgage Loan Originator must be assigned and sponsored by the applicant. The MLO Employment History must be accurate.Submitted via: NMLS
Step 18
Management Chart: Submit a Management chart displaying the applicant’s directors, officers, and managers (individual name and title). Must also identify compliance reporting and internal audit structure. This document should be named [Company Legal Name] Management Chart. Note: If the existing uploaded management chart already includes the above information, an additional document does not need to be uploaded.
