Legal Description: A Nevada Mortgage Loan Originator License is a regulatory license issued by the Nevada Division of Mortgage Lending that authorizes a natural person to engage in mortgage loan origination activities involving real property located in Nevada.

  1. Step 1

    Company Sponsorship/Relationship: A sponsorship request must be submitted by your employer. A corresponding relationship to a Nevada licensed or otherwise exempt office location required. Note - License cannot be issued without valid sponsorship from a location licensed with The State of Nevada.

    Employment: If you have additional current employment that is not related to your Nevada Mortgage Loan Originator license, enter a note following your title “No NV Origination” in the Position Held field. Note – If there are duplicate open employments, company generated or self-reported, present, the self-reported entries must be deleted.

    Veterans Questionnaire: Pursuant to NRS 417.0194, the Nevada Mortgage Lending Division is required to collect information regarding the Veteran status of all individuals that either apply for a license, are approved for a license or renew a license. Click here to access the form.

    SOGI: Pursuant to Senate Bill 109, the collection of information related to sexual orientation and gender identity or expression should be gathered by governmental agencies. Such information is protected by provisions in chapter 239B of the Nevada Revised Statute (NRS) as confidential information. The gathering of information and data reported in the aggregate are intended to enhance and improve public services of governmental agencies. Senate Bill 109 was passed and approved during Nevada’s 81st (2021) Legislative Session and enacted into law effective October 1, 2021. Please note, you are not required to provide any of the following information, nor will you be denied of any services or assistance should you choose not to complete this questionnaire. General information

Who Is Required to Hold This License? Pursuant to NRS 645B.0125(1) and NRS 645B.410, a Mortgage Loan Originator License is required for any natural person, including a designated qualified employee, who engages in mortgage loan origination activities on behalf of a licensed mortgage company or for hire serves as an agent for any person who has money to lend, if the loan will be secured by a lien on real property. This includes individuals who: • Take or receive residential mortgage loan applications; • Offer or negotiate terms of a mortgage loan for compensation or gain; • Interact with borrowers regarding loans secured by a lien on real property located in Nevada; • Act as an agent for borrowers or lenders in connection with mortgage loans; • Offer or sell promissory notes secured by liens on real property; • Offer investment opportunities in such notes under securities exemptions. The license also applies to: • Independent contract loan processors or underwriters who are associated with a mortgage company or an entity holding a certificate of exemption under NRS 645B.016(7); • Sole proprietors who conduct mortgage loan origination activities on behalf of their licensed mortgage company; • The Qualified Employee designated by a mortgage company licensee. Note: A "residential mortgage loan" is defined as any loan primarily for personal, family, or household use that is secured by a mortgage, deed of trust, or other consensual security interest on a dwelling or residential real estate, including mobile homes, as defined in the federal Truth in Lending Act. Who Is Not Required to Hold This License? Individuals engaging in regulated activities described above must be licensed. Persons who do not perform such activities, or who fall under a statutory exemption, are not required to hold a mortgage loan originator license. Prohibitions & Disqualifying Conditions (per NRS 645B.410) An applicant will be denied a Mortgage Loan Originator License or may be denied renewal if they: • Have been convicted of, or pled guilty or nolo contendere to, a felony: • Within the last 7 years, or • At any time, if the felony involved fraud, dishonesty, breach of trust, or money laundering; • Have had a mortgage loan originator or financial services license revoked within the preceding 10 years; • Have made a false or misleading statement on the application; • Have violated any provision of NRS Chapter 645B, related regulations, or a lawful order issued by the Commissioner; • Have not demonstrated financial responsibility, character, or general fitness to operate honestly, fairly, and efficiently; • Have failed to remit required fees to the Division or the State of Nevada; • Fail to comply with Nevada or NMLS licensing or renewal requirements, including: • Completion of required pre-licensure or continuing education, such as Nevada 30 hours PE requirement or 8-hour CE requirement • Are not sponsored by a licensed mortgage or otherwise exempt company through the NMLS. Important Considerations • Temporary Authority to Operate: Applicants must meet all licensing criteria (except education or testing) to maintain temporary authority. Any deficiency that results in an Intent to Deny will revoke the temporary authority, and the application will proceed under standard review with the possibility of denial. • License by Endorsement (NRS 622.530): Applicants wishing to apply under the Nevada license-by-endorsement law must email a request to: Licensing at mldlicensing@mld.nv.gov (Include your full name, contact information, and a summary of your current license qualifications.) Pre-licensure Education: Prior to submission of the application, complete at least 30 hours of NMLS-approved pre-licensure education (PE) courses which must include 4 hours of Nevada content. Testing: Must satisfy one of the following three conditions: • Passing results on both the National and Nevada State components of the SAFE Test, or • Passing results on both the National and Stand-alone UST components of the SAFE Test, or • Passing results on the National Test Component with Uniform State Content
