Legal Description: A Nevada Mortgage Servicer License is a regulatory license issued by the Nevada Division of Mortgage Lending that authorizes a person or entity to service mortgage loans secured by real property located in the State of Nevada.

  1. Step 1

    Financial Statements: Upload an independently audited financial statement prepared by a Certified Public Accountant in accordance with Generally Accepted Accounting Principles dated not earlier than the last day of the applicant’s fiscal year end. Financial statements should include a balance sheet, income statement, and statement of cash flows and all relevant notes thereto. If the applicant is a start-up company, only an initial statement of condition is required. The financial statement must illustrate a company net worth of $100,000. See the License Requirements and Fees Chart on the NMLS Resource Center for details related to this Requirement.

  2. Step 2

    Other Trade Name: If operating under a name that is different from the applicant’s legal name, that name (“Trade Name”, “Assumed Name” or “DBA”) must be listed under the Other Trade Names section of the Company Form (MU1). A licensee may have one assumed or fictitious name per license. If a licensee wants to conduct business using additional assumed or fictitious names, a separate license (Mortgage Servicer License-Other Trade Name #) must be applied for and obtained under each additional assumed or fictitious name.

    Resident/Registered Agent: The Resident/Registered Agent must be listed under the Resident/Registered Agent section of the Company Form (MU1) and must match the information currently on record with the Nevada Secretary of State.

    Non-Primary Contact Employees: The Nevada Division of Mortgage Lending requires that an individual(s) be identified as a Non-Primary Contact for the following areas. These contacts must be listed in the Contact Employees section of the Company Form (MU1). • Licensing • MCR • Exam Delivery • Pre-Exam Contact

    Bank Account: The following bank account information must be completed in the Bank Account section of the Company Form (MU1). • Provide information for the Applicant’s escrow/trust account(s) with an FDIC-insured institution through which borrower payments are processed.

    Qualifying Individual: When completing the Qualifying Individual section of the Company Form (MU1), list the designated Qualified Employee (QE) for each location. The identified Qualifying Individual(s) must • have at least 24 months of verifiable experience in the business of servicing mortgage loans within the immediately preceding 5 years; • be designated by the licensee to act on their behalf and to supervise and control the conduct of business of the licensee at one location; • be employed and present at the location; and • have submitted to and successfully passed a background investigation. These individuals must be listed in the Qualifying Individual section of Company Form (MU1). Each registered branch must have a separate Qualified Employee who meets the requirements above.

  7. Step 7

    Credit Report: Each control person is required to authorize a credit report through NMLS. Individuals will be required to complete an Identity Verification Process (IDV) along with an individual attestation before a license request for your company can be filed through NMLS.

    Electronic Surety Bond: Electronic Surety Bond via NMLS in the amount described below furnished and submitted by a surety company authorized to conduct business in Nevada.     Business Plan: Upload a business plan outlining the following information: • Marketing strategies • Products • Target markets • Fee schedule • Operating structure that the applicant intends to employ. • Description of Servicing Business • Include a complete description of the applicant’s servicing business, stating whether it will service its own loans and/or loans on behalf of others; the computer software used for tracking client accounts; a copy of applicant’s servicing policy and procedures, including quality control procedures; the person or firm responsible for quality control and the experience in quality control; sample “hello” and “goodbye” letters; the name and contact information of the person who will be responsible for the Nevada portfolio of loans detailing knowledge and experience. Note: If the existing uploaded business plan already includes the above information, an additional document does not need to be uploaded. A company should only upload a single business plan. If state-specific material is required, this information should be added to the existing uploaded business plan.

  10. Step 10

    Nevada State Business license: Upload a copy of the State Business License (issued by the Nevada Secretary of State) or an application stamped as received by the Nevada Secretary of State.

    Local Business License: Upload a copy of an appropriate municipal business license for the company, if applicable, or an application stamped as received by the local licensing authority.

    Formation Documents: Determine the classification of the applicant’s legal status and submit a State certified copy of the requested applicable documentation detailed below. Original formation documents and all subsequent amendments, thereto, including a list of any name changes.   13. Step 13

    Management Chart: Submit a management chart displaying the applicant’s directors, officers, and managers (individual name and title). Also, identify the compliance reporting and internal audit structure. This document should be named [Company Legal Name] Management Chart. Note: If the existing uploaded management chart already includes the above information, an additional document does not need to be uploaded. A company should only upload a single management chart.

  14. Step 14

    Organizational Chart/Description: Submit a chart showing (or a description which includes) the percentage of ownership of: • Direct Owners (total direct ownership percentage must equate to 100%) • Indirect Owners • Subsidiaries and Affiliates of the applicant/licensee This document should be named [Company Legal Name] Organizational Chart/Description. Note: If the existing uploaded Organizational Chart/Description already includes the above information, an additional document does not need to be uploaded.     Qualifying Individual Resume/W-2s: Upload a resume and copies of W-2s or 1099s demonstrating the required experience of each Qualified Employee designated for an office location.

    Branch Locations: Submit a list of branch locations that will conduct mortgage servicing activity related to mortgage loans secured by real property located in Nevada. The list should include the street address of the branch, and the name, phone number, fax number, and email for the branch manager/qualified employee responsible for the mortgage servicing activity of the branch. Note: Each branch manager must submit a separate Qualified Employee Designation form with required attachments and meet the requirements of a Qualified Employee. All Qualified Employees must be listed in the Qualifying Individuals section of the MU1 form.

  18. Step 18

    Request for Local License approval memorandum: Email a request including the name of the applicant for licensure to the Licensing Unit at mldlicensing@mld.nv.gov. An approval e-mail will be sent to the contact person listed on the MU1.

  19. Step 19

    Request for NV Secretary of State approval memorandum: Email a request including the name of the applicant to the Licensing Unit at mldlicensing@mld.nv.gov. An approval e-mail will be sent to the contact person listed on the MU1. The Secretary of State, Commercial Filings Division’s website may be accessed for additional information at http://nvsos.gov.

  20. Step 20

    MU2 Individual FBI Criminal Background Check Requirements: The following individuals, as specified below, on the Company Form (MU1) are required to authorize an FBI criminal background check (CBC) through NMLS. Direct Owners A Control Person means: (a) An executive officer, director, general partner, trustee, member, qualified employee or shareholder of a mortgage servicer, licensee or applicant; or (b) A person who is authorized to participate in direct or indirect control of the management or policies of a mortgage servicer, licensee or applicant. Executive Officers • An Executive Officer means an officer, manager, partner or managing member of a mortgage servicer, licensee or applicant. The term includes, without limitation, a chief executive officer, president, vice president, chief financial officer, chief operating officer, chief legal officer, controller or compliance officer, or a natural person who holds any similar position. Shareholders • A Shareholder includes (1) any person that owns, or is authorized to vote directly or indirectly, any percentage of class of voting securities or voting interests of a mortgage servicer, applicant or licensee if the mortgage servicer, applicant or licensee has fewer than 20 stockholders or owners, or (2) Any person that owns, or is authorized to vote directly or indirectly, 10 percent or more of a class of voting securities or voting interests of a mortgage servicer, applicant or licensee if the mortgage servicer, applicant or licensee has 20 or more stockholders or owners. Qualified Employee CBC's are required for all Qualifying Individuals.

  21. Step 21

    Office Lease: Attach or upload a fully executed lease in the company’s name for the office location to be licensed. Leases must be executed by an officer of the company. Note: Additional information concerning the location to be licensed may be requested. Virtual offices, shared space locations, desk rentals, and/or home-based locations are prohibited.

  22. Step 22

    Office Location Pictures: Upload photographs showing the following, • the street address on building, • sign/directory of office number with licensee’s name, • proof of separate locking entrance (door ajar), • the office interior, and office door signage.

    Information Security Program: Companies must maintain an Information Security Program.

General information

Who Is Required to Obtain This License? Pursuant to NAC 645F.950, a Mortgage Servicer License is required for any person or entity who engages in servicing mortgage loans secured by real property located in Nevada, including: • The current owner of the promissory note, or an authorized agent of the owner, who: • Directly services a mortgage loan, or • Is responsible for daily interactions with the borrower or the management of the loan account, such as: • Collecting and crediting loan payments • Managing escrow accounts • Enforcing the promissory note or security instrument • Subservicers providing the services above by contract with a master servicer. Important: Any person engaging in the above activities must be licensed, unless an exemption applies under NRS Chapter 645F or associated regulations in NAC Chapter 645F. Authorized Activities Under This License A Nevada Mortgage Servicer License permits the licensee to engage in the following activities: • Servicing of first-lien mortgage loans • Third-party servicing of first-lien mortgage loans • Servicing of subordinate-lien mortgage loans • Third-party servicing of subordinate-lien mortgage loans Pre-Licensing Requirements Applicants must meet the eligibility criteria and submit the required documentation as outlined in the Nevada Mortgage Servicer License Application Checklist. This includes: • Submitting a complete application through the Nationwide Multistate Licensing System (NMLS), and • Providing supporting documents to the Nevada Division of Mortgage Lending within the required timeframe. Electronic Licensing: The Nevada Division of Mortgage Lending issues electronic licenses for mortgage servicers. No physical license will be mailed. Agency-specific requirements must be uploaded within 5 business days of the electronic submission of your application through NMLS.
