Step 1
Other Trade Name: DBA’s must be listed under Other Trade Names on the NMLS Company Form. UT-DRE requires a separate license for each “Other Trade Name.” Select UT-DRE Mortgage Entity License Other Trade Name #1, #2, etc. You must submit a Certificate of Existence from the Utah Division of Corporations for each dba license.Submitted via: NMLS
Step 2
Qualifying Individual: The Qualifying Individual must hold a Utah Lending Manager license.The Lending Manager will be listed under the Qualifying Individual section of the MU1, be designated as the Principal Lending Manager in their title and they must be sponsored by the company. Step 3
Financial Statements: See the License Requirements and Fees Chart on the NMLS Resource Center for details related to this Requirement. NOTE: Financials should be dated within 90 days of your fiscal year end. Financial statements should include a balance sheet, income statement, and statement of cash flows and all relevant notes thereto. Certificate of Authority/Good Standing Certificate: Upload a state-issued Certificate of Existence document from the Utah Division of Corporations demonstrating that the corporation or limited liability company (LLC) exists or is authorized to do business in the state.Submitted via: NMLS Upload via NMLS under Document Upload Section
Step 5

Who is required to have this license?
Any entity (corporation, a limited liability company, a partnership, a company, an association, a joint venture, a business trust, trust, or another organization) that engages in the business of residential mortgage loans for compensation, or in the expectation of compensation, including originating a residential mortgage loan, directly or indirectly soliciting, placing, or negotiating a residential mortgage loan for another, or rendering services related to the origination of a residential mortgage loan, including taking an application and communicating with the borrower and lender.
Who does not need this license?
• Entities exempt through federal statute or created by a governmental entity (i.e. Utah Housing Corporation, the Federal National Mortgage Corporation, etc.) See Utah Statute 61-2c-105(2)(d).
• Depository institutions or affiliates or entities acting on their behalf.
• A nonprofit corporation that is exempt from paying federal income taxes; is certified by the United States Small Business Administration as a small business investment company; is organized to promote economic development in the state of Utah; or has as its primary activity providing financing for business expansion.
• Agencies of the federal government, or any state or municipal government, or any quasi-governmental agency making mortgage loans under the specific authority of the laws of any state or the United States
