Who Is Required To Have This License? Individuals who: • service closed-end consumer-purpose first mortgage loans, including modifications or assumptions, or • originate or service open-end or subordinate lien mortgages. Do not apply for this license if you already have an MLO license from the Utah Department of Commerce Division of Real Estate (DRE). The DFI waives its license requirement for such MLOs, and they do not need to apply for a waiver.   1. Step 1

    Company Sponsorship: Sponsorship is not required. The Utah DFI will neither approve nor deny sponsorship information entered into the NMLS. You may interpret this lack of action as a non-objection.

  2. Step 2

    Surety Bond: An individual must be covered by a surety bond that meets minimum surety bonding requirements based on origination volume. The surety bond can be for the individual or for a business entity (employer) that elects to provide coverage for multiple individuals. Surety bond requirements for individuals and business entities are outlined in Utah Administrative Code R343-5-2 and R343-5-3. If you wish to obtain our bond form, please email your request to msb.dfi@utah.gov.

If you are providing an individual bond, name it MLO Surety Bond. If coverage is under a company bond, save both the bond and a statement from a company official confirming the MLO is covered as one file. Name it Surety Bond and MLO Coverage Confirmation.
