Kansas permissible fees
For first-lien residential mortgage loans, Kansas does not impose specific caps on fees (origination, application, processing, underwriting) unless the loan is subject to the Kansas Uniform Consumer Credit Code (U3C), which occurs when the loan-to-value ratio exceeds 100% or the parties opt in. In such cases, prepaid finance charges (including points and broker fees) are limited to 8% of the amount financed (total), with no more than 5% payable to the lender or a related party. For loans not subject to the U3C, fees are not separately capped but must be considered in determining compliance with the usury rate limit of 1.5% above the FHLMC conventional mortgage rate under K.S.A. 16-207(b).
